Phoenix editions are basically the normal edition with the suicide battery protection removed. I seem to recall that there might be some extra test menus and stuff. You would have to play it and see what happens. -
I assume you mean Bee Storm (ddp2)? As you didn't say WHICH files are missing I will have to assume that you're missing the pgm bios. The game is sort of playable, but eventually your ship and most of the enemies become invisible.

DVD drive won't recognize Dvd's anymore

I wouldn't be rummaging around in a laptop, that's for sure. Too much chance of breaking something. Have you tried using a USB DVD drive, see if that works? -
Microsoft issued a patch to close the exploit. I don't see the point in preventing homebrew from being run. After all, you own the xbox, not them. Perhaps them and Sony are secretly married.

The emulator may either run from the command-line (like DOS), or be difficult to use. A front end puts a nice easy-to-use menu for you, so that you don't have to struggle with the unfriendly emulator, the front end does the hard work for you.
