$ony Targeting Sites Selling Hd Loader!

Update: We received a bit more info on this from a victim who does not want to be identified as it could adversely affect his case, but he informed us that these are actual complaints the attorneys for $ony filed in California Federal Court! This goes way beyond what has happened in the past as they are no longer happy with offenders simply shutting down and signing something (C&D) saying you'll never do it again. It appears $ony is now going for damages and more in some cases!

 

I just received word via phone today that $ony is now sending C&D letters complete with their legal team contacts to US-based Web sites selling HD Loader! As a result, some sites have already pulled the product while one site we are aware of is attempting to fight it. At this point in time there is no comment from the official HD Loader site (perhaps because they don't actually sell it), but I have a feeling HD Loader may indeed become more "homebrew" and less commercial in the upcoming months unless this legal matter gets resolved and $ony loses (doubtful).

 

As this news is NEW to us even, we don't have a copy of an actual Cease & Desist letter, however, hopefully in the near future one of the targeted sites will post theirs for others to view displaying the exact details. At this point in time, we can only assume the infringement lies in either the fact that HD Loader allows individuals to rent games and copy them to their HDD on an unmodified PS2 console, or perhaps because some copyright $ony code was used in its creation.

well 2 main things caused this:

 

1. the fact that you can backup a game that you don't own on to the hard drive.

 

2. and the fact that the tools being used to make hd loader were from sony's dev kits that you must have permission by sony to use (kinda like M$ with sdk/xdk thing for xbox)

 

to me software like this should've been homebrew and never to be sold (you can put games on xbox's hdd, do you see ppl selling how to do that?).
