  1. RIAA milestone: First criminal suit against MP3 trader could mean jail time.

     

    A member of Internet piracy group Apocalypse Production Crew (APC) under the handle Dextro (nee Barry Gitarts) has been found guilty of piracy, and now faces criminal charges of up to five years in prison, a $250,000 fine and more.

     

    Gitarts, 25, was convicted of "conspiracy to commit criminal copyright infringement" and found guilty by a jury in US District Court for the Eastern District of Virginia yesterday for his 2003-2004 participation in a release group that provided pirated content on the Internet.

     

    The group, Apocalypse Production Crew, had a server in a Texas facility that Gitarts paid for and administered. From there, the group hosted and traded "hundreds of thousands of copies" of pirated music, movies, software, and games.

     

    In the ongoing campaign against piracy, there have been 15 criminal convictions against APC related to software piracy, part of 56 total during the Department of Justice's Operation FastLink, in which several "first release" groups were under FBI surveillance, and over 100 million dollars worth of pirated software and media were found and removed.

     

    Jail terms for pirates have not been uncommon in the past, but the is the first criminal case over sharing music.

     

    Last year, a man was sentenced to 46 months in prison for distributing faked certificates of authenticity for Microsoft software. A BitTorrent uploader last year could have faced a sentence exactly the same as Gitarts': up to five years in prison, a $250,000 fine, three years of supervised release and a "full restitution."

     

    Gitarts will receive his sentence on August 8, 2008, and could become the first person to go to jail strictly for uploading music to the Internet.

     

     

     

     

    Well it had to happen sooner or later. I know the ropes being in this predicament before. But unlike him mine was only money and no jail time was sought after. Good thing I hate Jail.

    While Michael Hollick, the actor who played the voice of Niko Bellic in Grand Theft Auto IV, complains that he didn't earn enough cash, fans of Guitar Hero are getting all the glory for themselves in the privacy of their own living rooms -- and Activision is giving them new gaming software to further the fantasy.

     

    When the house lights go down this fall, a new generation of axe shredders, drummers and fearless frontmen will come together and rock with Activision Guitar Hero World Tour. The latest installment from the best-selling video game franchise, Guitar Hero World Tour promises fans something new by marrying Guitar Hero's guitar gameplay with a band experience that combines wireless instruments with new online and offline gameplay modes.

     

    "Guitar Hero has set the standard for music-based gaming and with Guitar Hero World Tour and the game's groundbreaking Music Studio, we are once again delivering unprecedented innovation that has the potential to revolutionize consumer generated music, much in the same way that video sharing hubs have driven user generated video," Dusty Welch, head of publishing for RedOctane, said in a statement.

     

    A Social Gaming Experience

     

    The game will feature a newly redesigned guitar, a genuine electronic drum kit and a microphone, as well as a Music Studio music creator that lets players compose, record, edit and share their own rock and roll anthems.

     

    On the music front, Guitar Hero World Tour boasts master recordings from some of the greatest classic and modern rock bands of all-time including Van Halen, Linkin Park, The Eagles and Sublime. The company said the game will also offer more localized downloadable music than in previous renditions on all of the next-generation consoles.     Guitar Hero World Tour lets virtual musicians live out their rock and roll fantasies by playing either a single instrument, or any combination of instruments, in addition to the full band experience. That, said Michael Cai, a video game analyst at Parks Associates, may be a direct responses to the popularity of Rock Band.

     

    "Rock Band was pretty successful in differentiating from Guitar Hero, although it was late to market. With its band experience, Rock Band attracted a lot of gamers to buy its game either in addition to or instead of Guitar Hero," Cai said. "That's probably why Guitar Hero is adding the other instruments and enabling the full band experience."

     

    A Social Music Experience

     

    Guitar Hero World Tour also introduces Battle of the Bands mode which allows eight players to join online and challenge each other band-to-band to determine who is the best of the best. In the Band modes, up to four players can jam together, online or off, as they progress through the game, and in single-player Career Mode, players can jam on any of the instruments in branching venue progression enabling them to rock out in the order of their choice.

     

    "With the introduction of our advanced high-quality new wireless instruments, in-depth customization options and advanced online functionality, the game enables music fans and gamers globally to share in the most social and expressive music experience ever," Welch said.

     

    According to Cai, keeping the content fresh is insurance that keeps people playing games like Guitar Hero. Music games, he said, have been successful in selling content, either through digital distribution or through new endorsements of the game.

     

    "Keeping the content fresh is the only way they can keep making money. Otherwise it becomes old quickly and the gamers won't be excited anymore," Cai said. "That's another reason why they keep putting out new titles."

    More than 80,000 dead or missing in China quake

     

    More than 80,000 people are dead or missing from China's worst earthquake in decades, the government said on Thursday, as concerns rose that disease, the rainy season and aftershocks could bring yet more pain.

     

    Previously, authorities had said they expected the final death toll to exceed 50,000.

     

    Ten days after the magnitude 7.9 quake rocked the mountainous southwest of the country, relief efforts focused on the 5 million homeless and the millions of others facing disease and possible "secondary disasters."

     

    The government implored the international community to provide more relief aid, saying they needed more than 3 million tents and that just 400,000 had so far reached the disaster zone.

     

    As a measure of the urgency, Chinese President Hu Jintao made a personal visit to tent producers in the wealthy eastern province of Zhejiang to chivvy them on.

     

    "To have enough tents is an urgent task for us," Hu said.

     

    Hospitals in Sichuan province were overwhelmed by the nearly 300,000 hurt, prompting the government to send extra trains to ferry the injured to other parts of the country, state media said. Convoys of ambulances also carried the injured out.

     

    Rain and aftershocks have exacerbated the dangers faced by more than 100,000 troops assisting in the relief effort.

     

    "There have been constant aftershocks and the rainy season starts in June ... the earthquake has loosened the mountains," said Yun Xiaosu, Vice Minister of Land and Resources.

     

    "It is very likely to cause frequent geological disasters and to once again bring major losses to the quake area."

     

    Engineers are also monitoring more than 30 new lakes formed by landslides into river valleys, worried they could burst causing flashfloods into towns and tent cities.

     

    PLAGUE, MENINGITIS

     

    More than 5,000 health workers have fanned out to disinfect the hundreds of wrecked villages, and doctors and nurses are stationed round the clock in refugee camps.

     

    "We are most worried about plague, so environmental hygiene is of top importance. Such a huge movement of people inevitably means that all sorts of viruses and bacteria move with them. We are also afraid of meningitis," a health official in Mianyang told Reuters on condition of anonymity.

     

    Plague is carried by rodents and spread to humans via fleas. Meningitis, an inflammation of membranes covering the brain and spinal cord, is caused by bacteria and viruses. It can be fatal without prompt treatment.

     

    More than 20,000 survivors are packed into the Jiujiang Sports Stadium in Mianyang city, about a two-hour drive from Sichuan provincial capital Chengdu.

     

    The government ordered the urgent shipment of millions of doses of hepatitis, encephalitis, hemorrhagic fever and cholera vaccines to the area, state media reported.

     

    "LONG AND ARDUOUS TASK"

     

    Government figures showed the number of dead on Thursday exceeded 51,000, an increase of 10,000 on the previous day's toll. It said more than 29,000 were still missing.

     

    The possibility was raised that U.N. chief Ban Ki-moon might visit Sichuan after his trip to cyclone-struck Myanmar.

     

    Meanwhile, Premier Wen Jiabao returned to the wrecked county of Beichuan, where two-thirds of the population were killed.

     

    "It will be a long and arduous task for us to relocate the people and reconstruct the region," Wen said, according to state television.

     

    Local authorities plan to rebuild the Beichuan county seat at a new site in Anxian county, according to a preliminary plan yet to be approved by government.

     

    "Safety is the top priority in selecting a new location and reconstruction," Xinhua news agency quoted Beichuan's Communist Party chief, Song Ming, as saying.

     

    "We plan to build a monument and a memorial to commemorate the quake victims on the previous location."

     

    Even as rescuers pulled more bodies from the rubble of what was a primary school in Yingxiu, workers set off explosives in other parts of the town to clear the debris and engineers and soldiers worked on building a temporary bridge.

     

    Residents picked through the rubble of their homes.

     

    Liu Suqing, 33, said she would not leave the town until her 8-year-old son had been found. "We're still waiting for them to pull out his body. There are many still buried under the rubble."

  4. Orb Networks, who produce remote PC access/place shifting software naturally called Orb, have announced a partnership with BitTorrent which will bundle the filesharing client into the free Orb PC application.

     

    Since Orb makes users' PCs accessible through most Wi-Fi connected devices equipped with a browser, the new partnership looks to expand the BitTorrent experience. Perhaps in doing this, it will also expand the consideration given to the protocol by content providers.

     

    In North America, there is a dualism between ISPs and content providers regarding BitTorrent, and it was never highlighted better than it was in March of this year. ISPs Bell Canada and Rogers Yahoo have both openly engaged in traffic shaping to control the bandwidth consumed by users, with apparent prejudice against those using BitTorrent and other P2P services. Despite this fact, the CBC took a risk and became the first television network on the continent to make a full television show both ad- and DRM-free available for download through BitTorrent.

     

    The broadcaster hazarded an offer of legitimate content in an arena regarded as a haven for illegality, and many users suffered because of it. While some users claimed downloads took about 2.5 hours, those who were throttled were quoted 11 to 12 hour download times. However, many feel it was a step in the right direction.

     

    BitTorrent was shown to be blocked or throttled by Comcast, Cox, and Starhub in a recent study, yet more content continues to made available under the protocol legally.

     

    Norwegian film director Erik Sollheim told German daily news site Tagesshau.de why he made his popular TV series "Nordkalotten 365" available through BitTorrent: "We gave up control of our content the day we started broadcasting. For years our most popular content have been available on BitTorrent and on sites like YouTube anyway. DRM doesn't work. The only way to control your content is to be the best provider of it."

     

    With its Orb collaboration, BitTorrent makes its downloads streamable to practically any connected device, like the PS2, Xbox 360, and Nintendo Wii.

  6. University of Essex researcher disproves correlation

     

    US, May 20, 2008 - With the recent release of GTA IV, a game that allows you to steal cars, kill civilians, and conduct drive-bys, the topic of video game violence is back at the forefront of the media. While most gamers equate the potency of videogames to the violent movies that we've watched for years, the dissenting hand opposes violent video games due to their interactive nature.

     

    The advent of violent video games raises many questions. Has video game violence gone too far? Aren't M-rated games intended for mature audiences? Among the sea of good questions, the quintessential one arises, "Is there any scientific evidence to support the claims that violent games contribute to aggressive and violent behavior?" In the International Journal of Liability and Scientific Enquiry, University of Essex researcher Patrick Kierkegaard answers that query by stating there is no data to support the theory that videogame violence promotes violent crimes. His study interestingly provides the opposite correlation.

     

    Kierkegaard asserts that past studies were predominately biased. His data shows that there is no correlation between the rise of violent videogames and the amount of crimes committed. Despite violent games becoming more mainstream within recent years, statistics show that violent crimes committed from juvenile delinquents have declined since the early 1990s. "With millions of sales of violent games, the world should be seeing an epidemic of violence... Instead, violence has declined," wrote Kierkegaard.

     

    Even though Kierkegaard found no ties between real life crimes and videogame violence, he admits that more research needs to be done. He also doesn't rule out the possibility that videogames can influence behavior and emotion, noting that even books can spure violence in already sadistic individuals.

     

     

     

    I knew that this would come about one day. Too blame violence on gaming or even movies is just wrong. It is the person and not the say game or movie.

  7. GamePolitics is reporting that a Florida Judge has recommended that Jack Thompson be found guilty on 27 of 31 counts of misconduct and is awaiting a Florida Supreme Court verdict to back him up. Thompson is striking back with allegations against the Judge and others, complaining that loyalty oaths were never signed. "Tunis made 21 recommendations of guilt in relation to Thompson's participation in Strickland vs. Sony, an Alabama case in which the anti-game attorney represented the families of two police officers and a police dispatcher slain by 18-year-old Grand Theft Auto player Devin Moore. Tunis also recommended that Thompson be found guilty on four out of five counts relating to his 2006 attempt to have Rockstar's Bully declared a public nuisance in a case before Miami Judge Ronald Friedman. An additional two guilty counts stemmed from a non-video game matter."

  9. Although 2K's press office was unable to comment this afternoon, PSM and Electronic Gaming Monthly both have cover stories on the game in their next issues.

     

    Not many details are being shared online, although EGM does point out that there are "some potential graphical improvements" and that it will be out for the "2008 holiday season".

     

    BioShock came out on PC and Xbox 360 last summer and was one of our favourite games of the year, despite polarising opinion among gamers - and responsible for one of 2007's most memorable gaming moments, which brought the storyline to an impressive head.

     

    For those who never experienced it, the premise was that you survived a plane crash in the ocean and found your way to a utopian underwater city called Rapture where things had gone seriously wrong.

     

    Using a mixture of old-school projectile weaponry and genetic modifications, you had to help the people you met and deal with the iconic Big Daddies - monstrous, lumbering creatures encased in metal diving suits, who escorted twisted little girls around the city harvesting the substance that powered up your own genes, ADAM.

     

    Its path to PS3 has been long and confusing, with designer Ken Levine stating just after the game's release that "there is no secret plan about the PS3 that we're keeping from people".

     

    "There's no PS3 development going on that we're hiding," he added. That's what they all say.

     

    2K Marin is currently working on a sequel, due out in late 2009, and while the announcement made no mention of formats, a job posting suggested it could happen. So, BioShock on PS3 this Christmas, BioShock 2 on PS3, 360 and PC next Christmas? Stranger things have happened.

     

     

     

    Sweet now I can beat the game all over again on the PS3. I hope the graphics are as sweet as they were on the pc.

  12. Having nearly tripled its audience and added about 20,000 new applications over the past year, Facebook Inc.'s popular online hangout is about to undergo a housecleaning.

     

    Visitors who can't stand the clutter that's been piling up will be glad to see that the site's new look sweeps disparate bits of information into categories marked by tabs at the top of each user's customized home page.

     

    Basic personal background and interests will be filed under an "info" tab, for instance, while news about users' buddies' latest activities will land under a "feed" tab, pictures will be corralled in a "photo" section and applications will be easily located under a "programs" tab. That content is now scattered, creating a confusing mishmash that has frustrated some Facebook users.

     

    The facelift, in the works since January, is to debut in June.

     

    Besides tidying the site, the overhaul should give users more control over their profiles, Facebook managers said Wednesday as they previewed the redesign at the startup's Palo Alto headquarters. Users will be able to magnify information they want to emphasize and downplay other features, for example.

     

    Even so, many users are likely to protest, said Mark Slee, the Facebook product manager overseeing the facelift.

     

    "Change is difficult for our users, even positive changes," Slee said. "But we are pretty confident that we can walk everyone through this so they will be engaged with the changes and enjoy them."

     

    Facebook has had to quell two user rebellions since Mark Zuckerberg started the site a little over four years ago while he was still an undergraduate at Harvard University.

     

    In 2006, users railed against a feature called "news feed" as too intrusive because it shared too much information about their activities. The backlash caused Zuckerberg to apologize and tweak the application to give users more control over how the information was shared. The news feed is now a Facebook staple.

     

    Zuckerberg, 24, apologized again late last year after a tracking tool called "Beacon" caught users off guard by broadcasting information about their shopping habits and personal preferences expressed by their activity at other Web sites. Facebook decided to allow users to turn off Beacon, diminishing its reach and possible value to advertisers.

     

    Despite those hiccups, Facebook has emerged as Silicon Valley's hottest startup since Internet search leader Google Inc., which recently has been losing some of its prized employees to Facebook. Ben Ling, a former top engineer at Google, is part of the team working on Facebook's overhaul.

     

    Microsoft Corp. put its stamp of approval on Facebook late last year by paying $240 million for a 1.6 percent stake in the startup — a deal that implied a $15 billion value for Facebook.

     

    Since dropping a $47.5 billion offer to buy Yahoo Inc., Microsoft reportedly has been mulling a bid for Facebook, although Zuckerberg has repeatedly indicated he wants to preserve the privately held company's independence.

     

    Facebook turned into a potential gold mine as it extended beyond its initial goal of allowing college students swap information about each other. The site now has 70 million users worldwide, up from about 24 million a year ago.

     

    Zuckerberg's decision to open Facebook to outside applications last year has played a key role in Facebook's rapid growth. Since then, developers have contributed 20,000 applications that make it easier to distribute photos, share music and play games.

     

    But all those programs were starting to make Facebook look jumbled — a problem that also has plagued the Internet's largest social network, News Corp.'s Myspace.com.

     

    Facebook is trying to address the situation without alienating the outside developers who helped fuel the site's success. That's taken on added importance since Google launched a network last year to help developers create applications to run on multiple Web sites.

     

    After spending months addressing their concerns, Facebook plans to open a "sandbox" where programmers can experiment with how things will work at the redesigned Facebook.

     

    "There may be some short-term pain, but I think there will be more long-term gains," predicted Ling, who is Facebook's director of platform product marketing.
